On 14 September 2026, the Secretary of State for Energy Security and Net Zero granted the Development Consent Order (DCO) for the Morgan and Morecambe Offshore Wind Farms: Transmission Assets.
As part of the DCO, powers have been granted to Morecambe Offshore Windfarm that enable the compulsory acquisition of land, interests in land and rights over land where required to deliver the authorised development.
Statutory Notice (Section 134) – Land acquisition rights
Under Section 134 of the Planning Act 2008, individuals and/ or organisations with a legal interest in land that may be affected by these powers must be formally notified.
It is important to note that receiving a Section 134 Notice does not mean that land or rights are being acquired immediately, nor does it mean that compulsory acquisition powers will necessarily be used.
The notice is intended to inform affected parties that the DCO includes these powers and to make them aware of their legal position.
